1:00pm - 1:50pm Doing Business with a Debtor Before, During and After a Chapter 11 Proceeding
Speakers:
Bruce Nathan,
Member in the firm's Bankruptcy, Financial Reorganization & Creditors' Rights Group, Lowenstein Sandler & Wanda Borges, Principal member of Borges & Associates, LLC

In today’s economy, credit executives often deal with a customer who is at risk of filing a chapter 11, is a debtor in possession in chapter 11 or has just emerged from a chapter 11 proceeding.  In a chapter 11,  a trade creditor doing business with a debtor-in-possession might be unsure of its rights, protections and obligations.  In fact a creditor might even not be sure when a customer is or is not “out of bankruptcy”.

This program has been designed to provide you with information and the tools to use at each of these time frames.  Issues which will be discussed include:

● Warning Signs of a Troubled Company, sources of information that predict a future bankruptcy, and tools available to protect your company prior to a bankruptcy proceeding

● Guidelines to doing business with a chapter 11 debtor, how to make that decision, the right and wrong ways of switching from credit to cash terms, and what to look at for financial information

● When is your customer really “out of bankruptcy” and what does this mean?
